Copyright Agreement: The customer is responsible for the content of the transmitted files. By transmitting the files to Capture Albums LLC, the customer confirms, represents and warrants that he/she has all copy-, trademark- and all other intellectual property rights to such files and their content that are necessary for Capture Albums LLC, to process the order. The client is responsible for any consequences resulting from a violation of these rights. Should any third party bring a claim against Capture Albums LLC, based on a violation of its intellectual property rights to the transmitted files or their content, the client shall indemnify and hold harmless Capture Albums LLC, from all such claims, damages and costs (including attorneys’ fees) arising in connection therewith. Capture Albums LLC will promptly inform the client of any such third party claims. By placing his/her order, the customer represents and warrants that the content of the transmitted files do not violate any criminal laws. Should Capture Albums LLC notice a breach of this representation and warranty, it will promptly inform the competent criminal authorities.


Capture Albums LLC holds the rights to all designed digital layouts produced and submitted to the customer. Only digital layouts may be used in marketing material to reflect competency of our services; but in no way will these images or layouts be sold for a profit. For the privacy of all individuals in those photos/images no names will be shown in conjunction with those photos/layouts. When photos/images are submitted directly to Capture Albums LLC by a photographer/studio and if Capture Albums LLC chooses to use those digital layouts for marketing purposes, credit will be given to that photographer/studio via watermark logo.


Deposit Policy: Client acknowledges and agrees that the deposit amount is due upon the signing of this Agreement and is not refundable. Both parties agree that the Deposit will be credited towards the total Fees payable by Client. Capture Albums LLC must acknowledge receipt of deposit in order for design to commence. If client changes his/her mind after paying the deposit and no design work has begun, then Capture Albums LLC will fully refund the deposit. In all other cases, absent exigent circumstances, deposits are non-refundable.


Invoice: Capture Albums LLC will issue a final invoice to Client upon album approval/prior to printing. Client is responsible for submitting payment within 7 days of album approval. Albums will not be sent to print unless balance of invoice is paid in full. Capture Albums LLC has created the following policies and deadlines to help ensure your album design project is completed within a reasonable timeframe. Capture Albums LLC will attempt to contact client with reminders as these deadlines approach to help client avoid any additional fees or deletion of your project files. If balance is not paid in full, client shall incur a late fee of $25.00 per month. After 6 months, if the album design is not paid in full by the client, Capture Albums LLC will consider the project abandoned and all files will be deleted. Capture Albums LLC will retain its' right to pursue collection, including reasonable attorneys' fees.


Image Share Policy: Clients will provide Capture Albums LLC with potential photos to be included in an album. Clients can either pre-select images or have the option for Capture Albums to organize/select from a designated pool. If client chooses the latter option, the following number of photos can be submitted. If client shares beyond the included limit, an added fee of $25 per additional 100 photos will be charged. Image Share Fees are due prior to the start of album design, and are non-refundable. Any amount of photos exceeding these limits may, at the discretion of Capture Albums LLC, cause the album package to go to the next largest size/price point. 


  • Small Album Package - client can share up to 500 photos
  • Medium Album Package - client can share up to 1,000 photos
  • Extra-Large Album Package - client can share up to 2,000 photos


Revisions Policy: For each album design order, up to two rounds of revisions are included in the price. If you need more than two rounds of revisions, we charge $50 per additional round. A "revision" is considered a request for alteration of an existing design with specific instructions for placing, replacing, resizing, or altering specific images or text on specific pages. The following does not constitute a revision: complete re-design of the majority of pages in an album, vague (non-specific) requests to alter the design, re-submission of new images which require a re-design of the majority of pages, re-submission of retouched images for the majority of the design, or alteration of the dimensions or orientation of a design. If there are requests to remove pages from the original design, we will still charge for those pages in the final fee.


Once client receives design or image files from Capture Albums LLC, it is client's duty to perform a final check on and provide final approval of spelling, dates, alignments, colors, strokes, and other design elements. This is a custom item, and client is responsible for proofing his/her design before the final version is sent to print. Capture is not responsible for errors after client has approved album. Designs can not be edited, altered or amended after final approval. No refunds will be given if client fails to properly proof his/her design.


Client is responsible for sharing their revision requests and finalizing their album design in a timely manner. We have created the following policies and deadlines to help ensure your album design project is completed within a reasonable timeframe. We will attempt to contact you with reminders as these deadline dates approach to help you avoid any additional fees or deletion of your project files.


60 Days from 1st Proof: The balance for all album design orders is due 60 days after the first proof link is sent, otherwise the order will be purged from our system.


6 Months from 1st Proof: After 6 months, if the album design is not finalized by the client, a $250 fee will be charged to keep your project design active.


One Year from 1st Proof: If album design has not been completed within one year from the first proof, a $450 fee will be charged and we will consider the project abandoned and all files will be deleted.


Images & Security: When client submits his/her photos to Capture Albums LLC they will be downloaded and saved for use during album design. Once design work is complete, Capture Albums LLC will disconnect/unsubscribe from any shared photo accounts and delete the original photo files that were downloaded. In this way, Capture Albums LLC does not retain any of images after completion of an order. However, Capture Albums LLC does retain the original design files created, and maintain them (1) as a record of the work completed and (2) in case client would like to order an additional copies in the future.


Capture Albums LLC may use third party sub-contractors (hereafter Sub-Contractors) to complete orders in whole or in part (ie: printer). Personal data and photos are only transmitted to a Sub-Contractor to the extent it is necessary to process and complete orders.


Miscellaneous:

1. Any disputes arising in connection with this business relationship shall be exclusively governed by New Jersey law. New Jersey shall be the agreed upon forum for resolution of any disputes under the terms of this agreement.

2. Should any one or more provisions of these terms & conditions and/or of the contract entered into in connection therewith, or parts thereof, be held invalid or unenforceable, the validity of the remaining provisions, or parts thereof, shall not be affected. They shall remain valid for both parties. In case of invalidity, the relevant statutory law applies. This also applies in case of contractual gaps.

3. Force Majeure: Capture Albums, LLC shall not be liable for any failure or delay in performance of its obligations under this Agreement arising out of or caused, directly or indirectly, by circumstances beyond its reasonable control, including, without limitation, acts of God; earthquakes; fires; floods; wars; civil or military disturbances; acts of terrorism; sabotage; strikes; epidemics; riots; power failures; computer failure and any such circumstances beyond its reasonable control as may cause interruption, loss or malfunction of utility, transportation, computer (hardware or software) or telephone communication service; accidents; labor disputes; acts of civil or military authority; governmental actions; or inability to obtain labor, material, equipment or transportation.
